What Utah requires — before you file
1
3-month residency. You or your spouse must have lived in Utah for at least 3 months before filing for divorce.
2
90-day waiting period. Utah requires a 90-day waiting period from the date of filing before a divorce can be finalized.
3
Divorce orientation required. Both parties must complete an online divorce orientation before the court will proceed.
4
Parenting class required if children. Both parents must complete a parenting course when minor children are involved.
Utah uses 'legal custody' and 'physical custody.' Utah's 90-day waiting period and mandatory orientation are unique procedural requirements.
