What this form does

California courts need to confirm they have jurisdiction before making any custody order. The FL-105 is how you establish that. You list where the child has lived for the past five years, who they lived with, and whether any other court has ever made custody orders. If another state was involved, this form flags it.

Who needs to file it

Required in every case involving a child custody or visitation order — dissolution, RFO, parentage, or DVRO.

When to file it

File it with your initial petition or request. Courts won't make custody orders without it.

What happens after you file

The court reviews the UCCJEA declaration to confirm jurisdiction. If another state is involved, additional steps may be required before the California court can act.
