DV-115 - California Judicial Council

Request to Continue Hearing

Ask the court to reschedule your restraining order hearing to a later date.

What this form does

DV-115 is used when either party needs more time before the full DVRO hearing — to get an attorney, gather evidence, or resolve a scheduling conflict. Courts are cautious about granting continuances in domestic violence cases because the TRO remains in effect, but legitimate reasons are usually accommodated.

Who needs to file it

Either the protected person or the restrained person.

When to file it

File as soon as you know you need more time — before the hearing date.

What happens after you file

If granted, the hearing is rescheduled and the TRO remains in effect.

Filing fee: Free.
