Temporary Emergency Court Order (Ex Parte)
Ask the court to issue temporary orders right away, without waiting for the other party to be heard.
What this form does
FL-305 is used in ex parte proceedings — emergency requests where waiting for a regular hearing would cause immediate harm. You ask the judge for temporary orders on custody, support, or property before the other party has a chance to respond. The standard is high: you must show irreparable harm or immediate danger. If granted, a follow-up hearing is scheduled quickly.
Who needs to file it
Any party facing an emergency that cannot wait for the normal hearing process.
When to file it
File when there is an immediate threat to children's safety, financial assets, or other urgent circumstances.
What happens after you file
The judge reviews your papers, often the same day. If granted, temporary orders are issued and a hearing is set within days.
