Request to Enter Default
Ask the court to proceed without the other party when they have not responded within the required time.
What this form does
If the respondent does not file a response within 30 days of being served, the petitioner can ask the court to enter a default. FL-165 makes that request. Once default is entered, the respondent loses their right to participate in the case and the petitioner can proceed to judgment on their own terms.
Who needs to file it
The petitioner, when the respondent has not filed a response within 30 days.
When to file it
File after the 30-day response window has passed and the respondent has not appeared.
What happens after you file
The court enters the respondent's default. The case proceeds to a default judgment.
