Restraining Order After Hearing

The final restraining order the court issues after both sides have had the chance to be heard.

What this form does

DV-130 is the permanent restraining order issued after the full hearing. If the judge finds sufficient grounds, they sign DV-130 and it can last up to five years — renewable. It supersedes the TRO (DV-110) and becomes the enforceable order on record with law enforcement.

Who needs to file it

Issued by the court to the protected person after the restraining order hearing.

When to file it

Issued at the conclusion of the full hearing, typically within 21 days of the TRO.

What happens after you file

Registered with law enforcement. Served on the restrained party. Violation is a criminal offense.
