Request to Prohibit Use and Possession of Firearms
Ask the court to order the restrained person to surrender any firearms they own or possess.
What this form does
When a domestic violence restraining order is issued, the restrained person is legally prohibited from owning or possessing firearms. DV-108 formalizes that request and gives the court the information needed to include the firearms prohibition in the order. The restrained person must surrender all firearms to law enforcement within 24 hours of being served.
Who needs to file it
Filed by the protected person in a DVRO case.
When to file it
File with your DV-100 when you know or suspect the restrained person has firearms.
What happens after you file
The court includes the firearms prohibition in the TRO. The restrained person must surrender weapons immediately upon service.
