What this form does
The DV-100 is California's primary form for requesting a domestic violence restraining order. You describe what happened — in your own words — and ask the judge to order the restrained person to stay away from you, your home, your workplace, and your children. A judge can review it the same day you file and issue an emergency order before the other person is even notified.
Who needs to file it
Anyone who has experienced abuse, threats, stalking, or harassment from a spouse, partner, co-parent, family member, or someone they live or lived with.
When to file it
File as soon as you are safe enough to do so. Courts prioritize these filings. You do not need a police report or witnesses.
What happens after you file
A judge reviews your filing, often the same day. If granted, a Temporary Restraining Order (TRO) is issued. A full hearing is scheduled within 21 days.
