Request for Dismissal

Tell the court you want to stop your case entirely and close it out.

What this form does

CIV-110 is used to voluntarily dismiss a court case. In family law, this is how you tell the court you no longer want to pursue the divorce, RFO, or other matter you filed. If the other party has already filed a response, they must sign agreeing to the dismissal. Dismissed without prejudice means you can file again later. Dismissed with prejudice means you cannot.

Who needs to file it

The petitioner who wants to end the case they filed.

When to file it

File when both parties agree to stop the case, or when the respondent never responded and you want to walk away.

What happens after you file

The court clerk enters the dismissal. All orders in the case are cancelled. The case is closed.
